Posting of workers occurs if an employer who is based in another member state sends his employees to Germany for a specific period of time to perform work on his behalf there. By posting workers, employers are exercising their right to free movement of services. This right is enshrined in Article 56 of the TFEU. The rights of posted workers under labour law are specified in the Posted Workers Directive. The Directive defines the minimum rights of posted workers (e.g. pay, leave, housing) in the host member state. Under the Posted Workers Directive, employees thus benefit from certain conditions of employment that apply in their host country although they are employed in another member state.
